Sarajevo, 23 January 2026, dtt-net.com – The Constitutional Court of Bosnia and Herzegovina (BiH) today ruled as unconstitutional election of now former government of Serb entity by entity’s parliament, because it was mandated by the sentenced and stripped of president’s post Milorad Dodik.
“In the merits of the case, the Constitutional Court concluded that the disputed decisions in the period from their adoption on September 2, 2025 until their repeal on January 18, 2026 were in violation of Art. I/2. and III/3.b) of the Constitution of Bosnia and Herzegovina because they were adopted based on the Decision on the Proposal of a Candidate for the Prime Minister of the Republika Srpska adopted by Milorad Dodik on 23 August 2025, although his mandate as President of the Republika Srpska ended on 12 June 2025, the date on which the judgment of the Court of BiH became final, which had the legal consequence of the termination of the mandate of the President of the Republika Srpska, which was subsequently only declaratively stated in the proceedings before the Central Election Commission of BiH,” country’s top court ruled today.
